1. Introduction

These Terms & Conditions ("Terms") govern your use of the Quotik platform (the "Service"), operated by Quotik ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Service. These Terms apply to both customers seeking quotes and builders providing services through the platform.

2. Definitions

  • "Customer" — a user who submits a project for quoting.
  • "Builder" — a tradesperson or business registered on the platform to receive quote requests.
  • "Content" — photos, descriptions, and other data uploaded by users.
  • "AI Visualisation" — AI-generated images and cost estimates produced from user Content.

3. Customer Terms

  • You must provide accurate and truthful information when submitting a project.
  • You are responsible for ensuring you have the right to upload photos of the property.
  • AI Visualisations and cost estimates are indicative only and do not constitute a binding quote. A final quote must be provided by a builder.
  • Quote requests submitted through the platform are shared with your selected builder(s). By submitting a request, you consent to this data sharing.
  • Any contract for works is between you and the builder directly. Quotik is not a party to any such contract.

4. Builder Terms

  • Builders must provide accurate business details and hold valid qualifications and insurance relevant to the services they offer.
  • Builders must complete identity verification before receiving live quote requests.
  • Subscription fees are billed monthly in advance via Base44 Payments. Fees are non-refundable except as required by law.
  • Builders may cancel their subscription at any time. Access continues until the end of the current billing period.
  • Builders must respond to quote requests in a timely and professional manner.
  • Builders are solely responsible for the quality, legality, and safety of work performed.

5. Subscription & Payment

  • Builder subscription plans are billed monthly. Prices are displayed on the platform at the time of subscription.
  • Payments are processed by Base44 Payments (our payment provider). Your payment details are handled securely by the provider and are not stored by Quotik.
  • A 7-day free trial may be offered to new builders. If you do not cancel before the trial ends, your subscription will begin automatically.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

6. AI-Generated Content

The Service uses artificial intelligence to generate visualisations and cost estimates based on your uploaded photos and project descriptions. These outputs are provided for informational and illustrative purposes only.

  • AI Visualisations may not accurately represent the final outcome of any work.
  • Cost estimates are based on average industry data and AI analysis; actual costs may vary significantly.
  • Quotik does not guarantee the accuracy, completeness, or reliability of AI-generated content.
  • You should always obtain a professional, in-person quote before commissioning any work.

7. User Content & Intellectual Property

  • You retain ownership of the Content you upload to the platform.
  • By uploading Content, you grant Quotik a non-exclusive, royalty-free licence to use, process, and store your Content for the purpose of providing the Service, including AI processing.
  • You must not upload Content that infringes the intellectual property rights of any third party.
  • Quotik-owned materials, including the platform design, branding, and software, are protected by intellectual property laws and may not be copied or reproduced without permission.

8. Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the UK GDPR and the Data Protection Act 2018. By using the Service, you consent to the data practices described in the Privacy Policy.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any UK law.
  • Submit false, misleading, or fraudulent information.
  • Attempt to gain unauthorised access to the platform or its systems.
  • Use the Service to send unsolicited communications or advertise without authorisation.
  • Interfere with or disrupt the Service or servers used by the platform.

10. Limitation of Liability

  • The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Quotik excludes all warranties and conditions relating to the Service.
  • Quotik shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
  • Quotik acts as an intermediary between customers and builders and is not responsible for the conduct or workmanship of any builder. Any dispute regarding work must be resolved directly between the customer and the builder.
  • Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable UK law.

11. Account Suspension & Termination

  • We may suspend or terminate your account if you breach these Terms or engage in conduct that we consider harmful to the platform or its users.
  • You may delete your account at any time through the platform settings.
  • Upon termination, your right to use the Service ceases immediately.

12. Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under UK law, including rights under the Consumer Rights Act 2015. If you have a complaint about the Service, please contact us using the details below. If we cannot resolve your complaint, you may be entitled to use the Online Dispute Resolution platform at ec.europa.eu/odr.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes by posting the updated Terms on this page and updating the "last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where consumers have rights to bring proceedings in their local jurisdiction.
